PREPARATION OF AN ORDER AND CONDITIONS OF SALE

The website is intended to offer multi-brand products from Latin American designers and artisans.

By placing an order you express your intention to purchase the products contained therein, in accordance with these terms and conditions.

And Everybody Said may decide, at its discretion and without any compensation to you, not to accept orders, abnormal orders, orders that we suspect have not been made in good faith or orders that may be fraudulent.

PAYMENT METHOD, PRICES, TAXES AND DISCOUNT CODES

Once you have completed the purchase form, you must proceed to pay for your order using the payment methods specified on the website.

Upon payment, you will receive a proof of purchase as confirmation of your order, both on the website at the time of purchase and via the email address you provided on the purchase form, which includes: your order number, a summary of the items purchased and the shipping address. The contract will be concluded at the time you receive this confirmation, which will constitute your proof of purchase.

If at the time of making the payment an incident occurs that prevents it from being made, you will receive an automatic payment error message and your order will not be processed until the payment process has been successfully completed.

The prices of the products offered on the website are expressed in euros (€) including taxes, as are the costs of transport and handling of said products, and the final amounts of which will be indicated at the time of payment for each order. The price charged for a product will be the price in effect at the time the order is placed and will be reflected in the proof of purchase of the same. And Everybody Said may change prices at any time without prior notice. Price variations will only apply to orders after such changes.

All product prices shown are final prices, expressly including value added tax (hereinafter "VAT") or other taxes applicable in Spain, but do not include costs corresponding to transport and handling of the products, unless indicated. The charges corresponding to transport, handling and their corresponding VAT or other taxes will be shown on the website during the order processing and, in any case, on the purchase receipt once your order has been placed.

For purchases delivered outside the European Economic Community : any duties, taxes and tariffs that may apply due to the nationalization of the product (according to the regulations of the country or region in which you are located) are not included, and which you must pay to the corresponding customs authority at the time of delivery of your order. And Everybody Said has no control over such amounts, so any additional amount due to customs clearance will be your responsibility. Customs policies vary significantly from one country to another, so we recommend that you consult with the corresponding customs office for more information.

From time to time, And Everybody Said may offer you discount codes. Such discounts may only be applied in accordance with the instructions specified by And Everybody Said in respect of each code, and in any event you may only use one discount code per order. The use of discount codes will not be compatible with certain promotional actions and collections.

DELIVERY OF PRODUCTS

• For deliveries "within mainland Spain": the approximate delivery time is 3 - 5 working days after placing the order. If you do not receive the order within this time, you will have the right to request delivery from us, giving us a new reasonable delivery time. If this does not happen, you may cancel the contract and you will have the right to a refund of all amounts you have paid. The established delivery time will be calculated from the moment you receive your proof of purchase, unless you expressly and punctually tell us to make the delivery on a date after the indicated time.
• For shipments "outside mainland Spain" (including the Balearic Islands, Canary Islands, Ceuta and Melilla): the approximate delivery time will vary depending on each final destination, so we recommend that you track the status of your order online, by accessing the website of the shipping company that we have notified you of via email and using your tracking number (if applicable). And Everybody Said may reject orders that require a specific delivery time if this implies the impossibility of meeting said delivery time.

And Everybody Said shall not be liable for any delay or failure to deliver any product(s) if such delay or failure is due to circumstances beyond the control of And Everybody Said under law or generally accepted principle.

If you are not at the shipping address at the time of delivery, the carrier will attempt to deliver the package 1 (one) more time, and then leave it at its nearest facilities so that you can pick it up within the next 7 (seven) calendar days. If you anticipate any logistical inconvenience in the delivery of your order, please write us an email at hello@andeverybodysaid.com and we will do our best to organize a delivery method that best suits your needs.

Please examine the delivered package and the products received within 14 (fourteen) days from the date of delivery to you and check their condition and that the contents of the delivered package are complete. In the event that the product or products received do not correspond to those you ordered, or your order is incomplete or damaged during transport, please contact And Everybody Said through our customer service at hello@andeverybodysaid.com for assistance.

In case:

• If you intentionally, wilfully or unreasonably fail to deliver or delay receipt of delivery after we have notified you of attempted delivery of your requested order, or if you have provided us with an incorrect delivery address resulting in a failed delivery, the package to be delivered will be returned to And Everybody Said.
• After the delivery attempt, the order remains undelivered for the following 7 (seven) calendar days, and therefore, is returned to us undelivered, we will have the right to cancel the contract by returning the amounts paid less the costs incurred in shipping and return expenses.

 

AVAILABILITY OF PRODUCTS AND SERVICES

All products on our website are subject to limited production, so it is possible that stock shortages may occur in some of their variants.

We do not guarantee the availability of any product or service on the website. We reserve the right, without liability or prior notice, to change, suspend or discontinue the availability of any product or service.

PRODUCTION DETAILS

Each of the pieces is made individually in their respective workshops in various Latin American countries. Therefore, it is possible that details or aesthetic imperfections can be observed, which does not mean that the garment does not fulfill its function.

We are perfectionists and we take care of every detail of the pieces, but there are things that, when we make them by hand, are out of our hands.

RETURNS AND RIGHT OF WITHDRAWAL

Please note that we will only process returns and refunds for those products that have been purchased on our website and/or in person at our showroom in Madrid.

A. RETURN OF A PRODUCT DUE TO MANUFACTURING DEFECTS

You may return any product that has a manufacturing defect. Given the nature of the products purchased, you will have a period of 14 days from the date of receipt of the product to notify And Everybody Said of your lack of conformity with it. If this period is exceeded, any damages will be borne by the user.

The return of products with manufacturing defects will not entail any additional cost for the user. 

To formalize the return, you must contact And Everybody Said within the 14-day period granted, through hello@andeverybodysaid.com indicating the product or products to be returned, attaching a photograph, a detailed description of the defects observed in them and the order confirmation that you received on the day the purchase was made on our website or showroom.

Once And Everybody Said has received your communication, we will inform you within 3-5 business days whether or not the return of the product is appropriate. If the return is appropriate, And Everybody Said will inform you of the method of collection or shipment of the defective product.

Each product to be returned must be unused and with all its labels, packaging and, where applicable, documentation and original accessories that came with it. If you do not proceed in this manner, And Everybody Said reserves the right to refuse the return.

Once the product has been received and the defects have been confirmed, And Everybody Said will give you the option of replacing the product with another of identical characteristics, unless this option is objectively impossible or disproportionate for And Everybody Said.

In the event that, due to a lack of stock, another product with identical characteristics cannot be sent, you may choose between dissolving the contract (i.e., refunding the amounts paid) or requesting the sending of another model of the same cost as the one initially purchased that you voluntarily choose.

The delivery of the product with identical characteristics or the new model that you choose, as appropriate, will take place within the next 3 - 5 business days from the date on which And Everybody Said confirms the replacement of the defective product or the shipment of the new model.

Replacement, sending a new model or termination of the contract will not entail any additional costs for you.

If you cancel the contract, And Everybody Said will refund the full amount paid for the purchase of the defective product, except for shipping costs, within 14 (fourteen) calendar days from when you decided to cancel the contract. This refund will be made through the same payment methods that you used in the initial transaction.

B. RIGHT OF WITHDRAWAL

If you are not satisfied with the products received in your order, you may, in accordance with the General Law for the Defense of Consumers and Users, exercise your right to withdraw from the contract, having a period of fourteen (14) calendar days from the date you received them to return the entire order or, if you prefer, any of the products that will make up the total order.

To formalize the return, you must contact And Everybody Said via email at hello@andeverybodysaid.com indicating the product or products to be returned, a detailed description of the reason for the return and the order confirmation you received on the day the purchase was made on our website. Once this communication has been received, And Everybody Said will tell you how to proceed to exercise this right.

The costs of returning your order to And Everybody Said (such as shipping costs via courier companies) will be borne entirely by you, whether you return the entire order or decide to return only some of the products in that order.

And Everybody Said is not responsible for the courier company you hire to return your order. In this regard, And Everybody Said recommends that you ask the courier company to provide you with proof of delivery once the courier has deposited the product in the offices or warehouses of And Everybody Said, so that you have proof that the product has been delivered correctly to And Everybody Said.

The product must be unused and with all its labels, packaging and - where applicable - original documentation and accessory elements that came with it. If you do not proceed in this way or if the product has suffered any damage, you accept that the product may suffer a depreciation or that And Everybody Said may deny the refund.

If you decide to return the order in full and everything mentioned above is met, And Everybody Said will refund all amounts paid at the time of purchase except for the initial shipping costs to your address. If you only wish to return one or some of the products that are part of the order, And Everybody Said will refund the amount paid for such returned products excluding the initial shipping costs to your address that you paid for the entire order.

Once And Everybody Said receives the order and checks that it is in perfect condition, And Everybody Said will refund the amounts paid within 14 (fourteen) calendar days from receipt of the order. This refund will be made through the same payment methods that you used in the initial transaction.

Please note that you will not be able to exercise this right of withdrawal with respect to:

• Any product that has been manufactured to your specifications or has been clearly personalized.
• Any sealed product consisting of underwear that has been unsealed after delivery and cannot be returned for hygiene reasons.

In any case, if you wish to change any personalized product, do not hesitate to contact us. For us the most important thing is that your experience in And Everybody Said is positive before, during and after the purchasing process.
